K-1
K-1 Fiancé(e) Visa
Petition for a foreign fiancé(e) to enter the U.S. to marry the U.S. citizen petitioner within 90 days of admission.
The K-1 turns on two facts that are easy to state and fiddly to prove: that the couple met in person within two years, and that both are free to marry. Attest requests the travel records and the decrees, and reads the dates on them against the two-year window.
The document checklist
What the client is asked for — before you have to ask twice.
A new K-1 starts with this checklist already on the case. Your client sees it in the portal in their own language, uploads from their phone, and each item flips to received as it arrives.

What the evidence is measured against
An evidence map, criterion by criterion.
Attest reads every document on the case and maps it to the elements below — marking each one supported or a gap, and citing the page it relied on. A gap is stated plainly rather than papered over.
Where these cases get RFE’d
The grounds USCIS comes back on.
When a notice does arrive, upload it — Attest extracts each request, maps it against what you already have on file, and drafts a cited response plan. The response deadline it finds is docketed only after you confirm it against the notice page itself.
Two-year meeting not adequately documented
Photos without dates, or an itinerary with no boarding passes or entry stamps behind it.
Bona fide relationship and intent evidence thin
Statements of intent with nothing showing an ongoing relationship around them.
Prior marriages not terminated
A decree missing for either party, or dated inside the current relationship.
IMBRA deficiencies
Broker disclosures or consent forms omitted where they were required.
Legal capacity to marry in question
Age, jurisdiction, or an unresolved prior union puts capacity in doubt.
Bring a K-1 you already have open.
Nothing to migrate. Upload the file you’re working on and see a cited evidence map against these criteria.
