H-1B
H-1B Specialty Occupation
Nonimmigrant petition for a specialty-occupation worker requiring at least a bachelor's degree in a specific field.
An H-1B is a deadline problem before it is a legal one: a certified LCA, a cap window measured in days, and a duties breakdown that has to line up with a wage level and an SOC code across three separate documents. Attest reads the LCA and the offer letter together and tells you where they disagree.
The document checklist
What the client is asked for — before you have to ask twice.
A new H-1B starts with this checklist already on the case. Your client sees it in the portal in their own language, uploads from their phone, and each item flips to received as it arrives.

If it applies
8 items- H-1B registration selection notice (cap-subject cases)

What the evidence is measured against
An evidence map, criterion by criterion.
Attest reads every document on the case and maps it to the elements below — marking each one supported or a gap, and citing the page it relied on. A gap is stated plainly rather than papered over.
Where these cases get RFE’d
The grounds USCIS comes back on.
When a notice does arrive, upload it — Attest extracts each request, maps it against what you already have on file, and drafts a cited response plan. The response deadline it finds is docketed only after you confirm it against the notice page itself.
Specialty occupation not established
The duties read as generic, or the degree requirement isn't tied to a specific specialty. Attest flags a duties breakdown that could describe any role.
Beneficiary qualifications
The degree, the evaluation, or the experience equivalency doesn't reach the specialty the petition claims.
Employer-employee relationship / right to control
Third-party placement without the contracts and itinerary that show who directs the work.
Availability of work / speculative employment
No end-client work order covering the requested validity period.
Maintenance of status
A gap in the pay stubs, I-94s, or prior approvals that the timeline can't account for.
Bring an H-1B you already have open.
Nothing to migrate. Upload the file you’re working on and see a cited evidence map against these criteria.
